Solution:

Let the two numbers be x and y. Then, $ \frac{3}{10}x=\frac{36}{100}\times y $
$ \Rightarrow $ $ x=\frac{12}{10}y $ Also, $ x+y=88 $

$ \Rightarrow $ $ \frac{12}{10}y+y=88 $

$ \Rightarrow $ $ \frac{22}{10}y=88 $
$ \Rightarrow $ $ y=40 $

$ \therefore $ $ x=\frac{12}{10}\times 40=48 $

$ \therefore $ Smaller number is 40.
